Congo: Mr Malonga and Mr Hombessa lawyers arrested
The ASF Network is concerned about the situation of the two colleagues Mr Malonga and Mr Hombessa. Some members from ASF Congo have taken charge of the case.
Summary of the facts
Hervé Ambroise MALONGA and Gabriel HOMBESSA (member of ASF Congo), both registered at the Brazzaville Bar, were arrested last Monday 9 April 2012 by the police. They were working on the defence of Marcel NTSOUROU, who was arrested without guarantee of legal proceedings and kept incommunicado in the premises of the Directorate for the Surveillance of the Territory (Direction Générale de la Sécurité du territoire DGST), for the 4th March explosions in Mpila.
These lawyers sought to meet their client, however it did not came off. In order to denounce such infringement of the rights of the defence, Malonga and Hombessa decided to organise a press conference at the SAPHIR hotel, without success. So, they decided to carry out the conference to their client home address. They were then arrested and taken into custody at the central police station of Brazzaville for 24 hours.
The next day, they were brought before the Prosecutor of the Republic who decided to open an investigation with the senior investigating judge. They were accused and held in pre-trial detention to the Central prison of Brazzaville.
Several lawyers, including members of ASF Congo, agreed to work together on the case and submitted several requests for provisional release to the investigating judge, without success.
